What protects academic speech? Between academic freedom and freedom of speech in Brazil

The 1988 Brazilian Constitution protects both academic freedom and freedom of speech, but some concrete situations involving the scope and limits of academic discourse make its protective field tenuous due to the juxtaposition of these two freedoms. Based on the diagnoses of theoretical and jurisprudential gaps in providing clear conceptualization and criteria for regulating academic discourse in Brazil, this article presents definitions of academic freedom, freedom of speech, and academic discourse in light of the Brazilian Constitution. It also explores the three main justification theories of freedom of speech to verify which conception is compatible with the Brazilian constitutional framework of academic freedom. Finally, it argues that at least three elements - location, content, and audience - should be considered in future investigations to explore possible criteria for the protection and regulation of academic discourse in Brazil.
