Economic and financial sustainability of urban solid waste (USW) management services: legal aspects and challenges for achievement

Funding for urban solid waste (USW) management services through specific charges tends to be nonexistent or insufficient in Brazil, proving to be a challenge for Brazilian municipal governance even with regulations governing USW management charges. In this context, we conducted a bibliographical review of the charging due to USW management services in Brazil, aiming to identify ways to ensure the economical and financial sustainability of these services. We approached the legislative evolution of the subject first, leading to the basic sanitation legislation and then the PNRS. Subsequently, we discuss the economical and financial sustainability of USW management services presenting the current situations of charges in the country, their legal validations, and their issues. Finally, beyond solutions involving the initiative of the Public Power, we propose the judicialization of the agenda for municipalities where charging is absent or insufficient/ineffective. This would ensure the economic and financial sustainability of USW management and the perpetuation of the service, given that it is also a dimension of the constitutional right to an ecologically balanced environment.
