Competitive effects of exclusivity agreements on streaming platforms - panorama in the phonographic and audiovisual markets

The offer of streaming services transformed the dynamics of phonographic and audiovisual markets worldwide. Among various relevant contractual arrangements that can be considered relevant from an antitrust point of view, exclusivity agreements have become popular as an attempt to gain economic efficiency by market agents. In such context, this article aims to analyze the effect of exclusivity agreements in streaming platforms business. Therefore, the study analyze whether exclusivity agreements impact the competitiveness of audio and video streaming markets. To organize these answers, the study differentiates and addresses the general framework of music and video markets, enabling the analysis of different pricing strategies and user behavior. The study concludes that potential benefits of exclusivity agreements observable in other markets are not clear enough in the streaming markets, requiring careful analysis by antitrust authorities due to particularities of sectors involved.
