Alterações climáticas, iminência e proteção de direitos humanos: algumas notas a propósito do caso Teitiota c. Nova Zelândia

No caso Teitiota c. Nova Zelândia, apreciado pelo Comité de Direitos Humanos das Nações Unidas, discutem-se alguns dos efeitos atuais mais visíveis das alterações climáticas. O CDH avaliou uma alegada violação do direito à vida, mas, infelizmente, optou por um critério de iminência do risco demasiado exigente que se afasta, não apenas daquilo que o Tribunal Internacional de Justiça tinha, a respeito do mesmo conceito, exposto no caso Gabcíkovo-Nagymaros, como da “iminência” usada, por exemplo, nas teses atuais sobre o uso da força. Além disso, tanto como a questão grave de direitos humanos e a definição urgente e necessária de um “novo” estatuto de proteção internacional, o risco de desaparecimento do território (ou de parte significativa deste) de vários Estados por efeito da elevação do nível dos oceanos atinge o direito de autodeterminação dos povos e coloca desafios ao próprio conceito de Estado.Downloads
