The future of Productive Development Partnerships and their impact on the Economic and Industrial Health Complex: the role of the Ministry of Health, public laboratories, and the pharmaceutical industry within the new regulatory framework of PDPs

Abstract

This article provides a critical analysis of Ordinance GM/MS n. 4.472/2024, which establishes a new regulatory framework for the Partnerships for Productive Development (PDP). PDP are pivotal tools for enhancing Brazil’s Health Economic-Industrial Complex (CEIS) and fostering technological autonomy within the Unified Health System (SUS). The study contrasts the

innovations introduced by this regulation with their predecessor (Ordinance GM/MS n. 2.531/2014), highlighting advancements in governance, technology transfer, evaluation criteria, and sustainability. Despite notable progress, the article identifies persistent challenges, including the absence of robust economic incentives and the need for greater regional decentralization. This study adopts a qualitative approach, based on documentary analysis and a critical review of normative and institutional literature. It examines Ordinances GM/MS No. 2,531/2014 and No. 4,472/2024, the Federal Court of Accounts’ rulings concerning PDPs, as well as relevant academic articles and technical reports. The methodology consists of a systematic comparison between the previous and the new regulatory frameworks, aimed at identifying key advances, persisting limitations, and the expected impacts on Brazil’s Health Economic-Industrial Complex. The article is divided into seven sections: introduction; innovation strategies within the CEIS; objectives and practice of PDPs; progress and obstacles under Ordinance No. 2,531/2014; the context of change following TCU Plenary Decision No. 2015/2023; innovations and challenges introduced by Ordinance GM/MS No. 4,472/2024; and conclusions regarding its impact and alignment with the expectations of the stakeholders involved. Through detailed analysis, the study assesses the extent to which the new regulation fulfills the expectations of public and private stakeholders, as well as the recommendations of Brazil’s Federal Court of Accounts, concluding that further adjustments are essential to position PDP as strategic instruments for public health in Brazil.
