Is the nationalization of civil society desirable? Thoughts based on the examples of the National Policy for Social Participation (2014) and the National Plan for Arts Promotion (2020)

This article, written under the premise of ontological relationality and contraposition between State and civil society, aims to reflect on the desirability of legalization and control of social spheres by the government. Using exploratory bibliographic research, it addresses this issue critically from two state acts edited in Brazil under the command of different ideological matrices: The National Policy for Social Participation, 2014, and the National Plan for Arts Promotion, 2020. Initially, this is accomplished by analyzing the so-called June Journeys of 2013 occurred in the country, which are understood as the context for formulating and editing the Decree no. 8,243/2014, which created the National Policy for Social Participation. Afterwards, the concept of civil society inserted in that Decree is exposed, comparing it with the theoretical framework on the theme. Finally, based on this theoretical framework, each of the aforementioned state act is faced, concluding that both are undesirable, since they reveal an autocratic assumption of subtracting from civil society and art their elementary characteristics of being alive and independent.
