Breves considerações sobre o contributo da teoria dos custos de transação ao debate regulatório

A Teoria dos Custos de Transação propõe uma análise microanalítica dos custos de transação de cada modo de organizar setores atualmente regulados, seja por instituições públicas ou privadas. A consideração precípua da análise pelos custos de transação é a existência inevitável de tais custos. Dessa forma, ao pretender uma análise microanalítica de cada modo de organização, pretende aclarar qual o melhor modelo regulatório para determinado setor e estágio de desenvolvimento. De tal análise não passam incólumes a regulação pelo interesse público, o argumento de monopólio natural, a regulação por incentivo ou a regulação pelo judiciário. Como corolário, o tratamento dos recursos que geralmente pugnam pela intervenção regulatória deve se pautar no cientificismo e debate que engloba os custos de se regular ou não, quais as falhas cognitivas e gerencias que podem surgir de cada modelo e quais os modelos mais aptos a garantir a eficiência da prestação daquele serviço.
